Challenge with moving from EB3 to EB2

Hi

 

I think a lot of people are in the same boat as me and are looking for a way to move from EB3 category to EB2 category. I read a few posts here in this forum and there is lot of discussion around job requirement for EB2 category.

 

My job actually requires an EB2 category, but due to my education background (not meeting the requirement of 4 year US Bachelor degree), my GC was filed in EB3 category.

My priority date is March 2012. And I have an approved I-140.

 

Obviously, I am looking to move to EB2 category. I already have a 3 year bachelor degree, 2 year part-time masters and another 3 year diploma in computer science; all education in India. Unfortunately, the institute from where I did my masters in India is not accredited. So, my single education is not considered an equivalent to 4 year degree in States. 

 

My question is little different. What degree/ schooling can I do here US that will make me eligible for EB2 category? I have gone through some of the universities here, like DeVry, Phoenix, San Jose or Santa Clara, etc.... (I am in Bay area). I am not sure what degree I need to get which, by itself, will be considered 4 year bachelor degree equivalent?

 

Can I do Executive MBA or what other options I have? Will that be equivalent to what is required for EB2 category?

I am not sure if this is the right forum to ask this question, but I wanted to give it a shot.

Any graduate degree related  to your occupation from accredited school in US will be OK. Private universities and for profit schools are not OK.

For EB-2 you require an advanced degree and you must possess such a degree or its equivalent (a baccalaureate degree plus 5 years progressive work experience in the field).

Your job doesn't require EB2, otherwise you wouldn't have qualified.

The company's decision to file in EB3 means that the company in essence stated that the job only requires a bachelor degree. Period.

Even if you get a Masters degree, your case would continue to be in EB3, because the job requirement, as shown, puts it in EB3.

Stanford, Harvard, USC, Johns Hopkins are examples of private universities.

If you  qualify for these, you won't have any issues anyway...

So, what's your confusion? The job requires a bachelor degree, so the case can only be in EB3. Period.
