Grao.srini Posted April 13, 2016 Report Share Posted April 13, 2016 Hi , I'm in my 6th year of H1B ( visa and i-94 till sept 2016). 1-140 approved with company A. Now i got a full time offer from company B who are ready to file labor and green card. 1) is it advisable to go for H1 transfer in 6th year? 2) should I immediately apply for a H1 extension from company A ? Once i receive extension for 3 years then can i go for H1 transfer with Company B? Does this has anything to do with 6 year limit here ? 3) is it true that i-140 with company A will not be revoked for 180 days? 4) Is there anything to keep in mind before 1-140 is revoked? It is an employer call to revoke the I140 or not. 4) Is there anything to keep in mind before 1-140 is revoked? Best if you have i140 approval notice.or better at-least i-140 case number. Safe move - Get your 3 years of H1B extension first based on the old i-140 once H1B is approved for 3 year, start GC with new employer at the earliest and you can use the old PD even if the old employer revokes your I140 (untill unless not revoked for Fraud) Link to comment
