bhaskar234 Posted March 29, 2016 Report Share Posted March 29, 2016 I am from India and I came to USA around 10 years back on F1 visa for my MS in Mechanical engineering. Then I started working in software, then moved to full-time MBA and then started working in Finance on H1B again. In all these years, apart from initial visa stamp, I got F1 visa stamp in 2012 but never H1B visa stamp. So, quite a few changes in the last 10 years but never have I gotten an H1B visa stamp. Now my employer wants to file my green card soon. I would like to get my H1B visa stamp in the next year or so. Is it better that I get my H1B visa stamp before my green card application is sent to USCIS and if yes, whether I should go to India or Canada? I would prefer to go to Canada. If no, should I expect some trouble when I will travel to India and get my H1B visa stamp (in a few months)? I am worried because H1B is sort of against intent to immigrate but green card application is the opposite. Thank you very much for your advice in advance. Link to comment

pontevecchio Posted March 29, 2016 Report Share Posted March 29, 2016 HI is not "Intent to Immigrate". H1 is DUAL INTENT and allows for Immigrant intent. As a stake holder ion the matter maybe get more acquainted with the system. GOOGLE can help. Your H1 visa will be dealt with on merits and if it is a reputable company, you should have no trouble.
