Timelines for my wife

 

May2012-got married in april2012 and applied H4 , approved till 19Mar2015.  

 

Mar2013: I20 issued (03/26/2013-03/26/2014) from College –xxxxxx  , Send USCIS for F1 COS , got approved in June2013 
 

June2013-F1(COS)  : New I20 issued  (06/03/2013-06/03/2014)  -College Name - xxxxxx Institute , Program : Professional Certificate -Web Development

 

Sep 2013 : Part Time CPT issued : Employer : Employer X

 

Nov2013  : Full Time CPT issued : Employer : Employer X with Client X

Jan2014-F1, new I20 (01/14/2014-01/14/2016 )with change of college , College Name : xxxxxx , Program : MS in MIS ,an accredited university, SEVIS updated , Full time CPT issued in the first semester: Employer : Employer X

 

Feb2014: got a new Client Y

 

Mar2014 : H1 Filed by Employer X in general H1b category and approved with COS in June 2014 for 3 years (Till Aug 2017) based on Client Y
 

Oct2014-H1b started, left the MS Degree program , same client Y

May2015-Child Born : NJ Short Term Disability applied ,
Aug2015-Resumed office after maternity for the same client Y

 

Sep2015: Changed the client Z,

 
26Oct2015- Went to India for H1b stamping in NewDelhi embassy,got 221g administrative processing,kept passport and i797 document.There was no case number issued or document asked as of yet.

 

5Feb2016- Embassy returned passport and kept I797 petition document with them Status still showing pending Admin processing for 120 days now.

 

20Feb2016: Send email to UStraveldocs to withdraw the H1b petition so that we can apply H4 visa

 

29Feb2016: CEAC shows Administrative processing and decision still lies pending with Embassy for h1b

 

Mar 1,2016: Applied for H4 dependent visa-qualified for dropbox with my husband i797 and visa copy. 

 

Mar8,2016: CEAC says went under administrative processing for h4 visa as well. No documents asked

 

Mar 11,2016 :for H1b petition , Dept of State has sent the case ReciptEAC1414451898 to USCIS, for review.

We have gone through enough stress for the last 5-6 months .How can this ordeal be finish and to bring my wife and US born 9 month baby back to US so that we can get united.Whom should i contact or any immigration attorney can help on that

This is what happens when you abuse immigration rules, abuse of CPT. Never ever try to abuse F1 rules.

 

Contact an immigration attorney for help, since your wife has abused F1 rules that's the only option you have.
