aarthiraman Posted February 29, 2016 Report Share Posted February 29, 2016 Hi, We had a son in September of 2015 and we have recently applied for a US passport for our son.(a week ago) We researched some and found that we could have applied for an Indian passport for our kid because we might go back to India within 5 years. Couple of questions: 1) Can we withdraw my son's application now and apply for a Indian Passport ASAP, if so what about visa to enter USA? 2) If we still apply for US passport and decide to go back to India for good, will my son be considered under NRI category till he turns 18 and decides on his citizenship? Also, Here is our situation: If in case my company applies for my GC, and if my US born son holds an Indian Passport, will my son also have to be considered in the GC application? JoeF Posted February 29, 2016 Report Share Posted February 29, 2016 The child is a US citizen, so the child would not get any visa for the US nor does the child need one. To enter the US, the child needs a US passport. Link to comment
sandra7985 Posted August 23, 2016 Report Share Posted August 23, 2016 Hi, Need Help Our son was born in 2012 and we took US passport and Indian PIO for him. I was on H-1 and my wife on H4. We went to India in 2012 when he was 3 months old. Now after 4 years I am back to US on H-1, and my wife was on F-1 and currently applied for COS to H-4. Our son is in India right now with his grand parents, They both have B-1/B-2 Visitor visa. My Question is If my son can come to US with his grandparents will there be any issue or problem at the port of entry because his parents(We) are not accompanying him. Or either of the parents are compulsory to accompany him while his port of entry. Please give us some suggestions. Thanks & Regards Link to comment
