Niktad Posted February 12, 2016 Report Share Posted February 12, 2016 Hello attorney I need a clarification from you for my few queries of Green card ; 1) my sister is a usa citizen she would like to file my family based green card -sibling 2) I am on h4 visa status and my husband on h1 we have completed 3.5 years on the visa status In usa 3) if my husband company starts our GC process for him or us and can my sister too file my Family based GC for me too then 4) would both green card process can cause a conflict with uscis and cause a rejection in both process or either one process. 5) if not then what is the actual process for family' based GC what documents and fees are required for the same. 6) and in case only my sister files only our GC would that give me EAD or immediate work option so that I can work in usa. pontevecchio Posted February 12, 2016 Report Share Posted February 12, 2016 You can have both processes in tandem. The procedures are in the USCIS website. You have a 13 year wait for F4. Please look up VISA BULLETIN and the classes with wait are explained. Link to comment

pontevecchio Posted February 15, 2016 Report Share Posted February 15, 2016 Both can go on. Your family based petition will take 13 years for an EAD. If your spouse gets an I-140 approved you can get a H4C EAD. You can also try and find a H1 sponsor on your own. Link to comment
