Context : Currently my employer A is holding my H1B for 6 years & already I-140 also approved. No issues at all with A and would like to continue. Another employer B is ready to file part-time concurrent H1B for me as they got a long term opportunity as they do many projects. Questions: - Any known issues having 2 H1Bs concurrently ? - Does part-time employer B also has to run payslip every month ? - Which one to be considered for visa/extension..etc ? - Can the part-time H1B just be taken for a project duration ? - Does 2nd one H1 from Emp B needs to be notified to Emp A at all from legal perspective ? (In fact I wanna notify just in case I would like to keep my employer A is permanent) - Any issues if H1 with Emp A gets into trouble ( say RFE on extensions ) then H1 with Emp B also gets same status or both independent ? I am kind of looking it as to fill gaps in project opportunities as Emp A is a purely into staffing but Emp B is totally a seasoned consulting company but small one. - Vik Link to comment
ivrs11 Posted February 11, 2016 Report Share Posted February 11, 2016 Maintaining dual status is illegal and technically not possible. your second employer can initiate transfer under cap exempt but cannot file H1 cap when Emp A H1 is still active. Link to comment
pontevecchio Posted February 12, 2016 Report Share Posted February 12, 2016 If A has no objection you can have an employer file a part time H1 petition for you and on approval you can work. Make sure A has no objections contractually. Link to comment
