kv1234
Hello, I am currently working with employer A with approved I-140 and valid H1 till Sep- 2017. I have applied for my wife's H4 and H4-EAD in Nov'2015 both applications are currently pending. I am planning to move to employer B. I understand that if you have file H4 and H4 EAD with H1B filed in premium processing they are all adjudicated and approved together.QUESTION - If I move to employer B can I refile for my wife's H4 and H4-EAD along with H1 transfer (which will be filed in premium) or do I have to wait for the previously filed H4 and H4 EAD applications to be processed before filing new ones again. pontevecchio
You can have the lawyer file the H4 status extension along with your H1 extension. You do not have to wait. Link to comment
kv1234
Thank you - pontevecchio Can i also file EAD again, along with H4 extension. Even though there is a pending EAD application filed from my previous employer? Link to comment
pontevecchio
The EAD is only connected to your valid H1 status and not any employer. Inform company B'S lawyer about the situation and ask him to file her H4 and EAD if PP is being used. Link to comment
