smiti1981
Hi , does any one know if we can re-use the I-140 ? My situation: full time (H1b transfered with I-140) got my H1B 3 yrs. my company started to initiate my GC last year , applied PWD salary came back very high . we modified the job description and refiled my pwd this month . my question : my h1b expires in july 2017, i am looking at processing times for PWD (60 days) and another 30 days for recruting and 30 days silent mode this takes me close to June to file my PERM( this wil work as along as my perm is filed) . if for some reason my perm got delayed , can i reuse my old I-140 to file my H1B? Any thoughts appreciated. Thanks Link to comment
rohang
are you sure your old I140 is still active? and was not revoked after you left? if it is still active, yes you can use it. Link to comment
Attorney_15
If an I140 is not revoked then it normally can be used by any employer to request H1b time for the I140's beneficiary. It is usually a good idea to check on the status of the I140 and to not assume that it is still approved. Link to comment
smiti1981
Appreciated and thanks for quick response. i looked at my I140 status it shows "Case Was Approved And My Decision Was Emailed" assuming its still active. Thanks Link to comment
