Urgent: I-94 Exipry

Hello everyone,

 

URGENT: Need everyone's inputs on how to proceed.

 

Problem: I-94 expired due to passport expiry with valid H1-B

Details:

H1-B Visa end date:   Sep 2017

Passport expiry date: Nov 13 2015

I-94 end date:            Nov 13 2015

====================================

 
My company lawyer inferred that since I overstayed, my Visa is now invalid.
But in various post in this forum say otherwise that Visa is still valid.
 
Questions:
1. Does overstay of I-94 invalidate H1-B visa?
2. Can I got to Mexico and get new I-94 on my way back?
3. Do need to get new Visa?

UPDATE:

 - Did the Mexico border dip.

 - Got new I-94 without any problems.

 - Justified asking for new I-94 as my passport was renewed.

 - CPB agent verified { Visa, I-979, Client Letter, Address Proof}

 - Total time at the agent counter <5 Mins.

 - Waiting time to get to the agent 3.5 Hrs

 - Joined queue on Saturday at 4 PM, which is bad time in hindsight.

 

Notes for those who plan to do the same

 - There is separate queue just for I-94 Permits

 - Don't join any other queues.
