paresh400
I have a quick question regarding my wife's I 94. According to her latest I 94, the Admit Until Date is October 13, 2015 as the date of her current passport expiry was October 13, 2015. The date on her stamped L2 visa on passport is June 4, 2016. The question that I have is, do we need to have her I 94 updated or as long as we exit from US before June 4, 2016 she will be fine. Note: She recently received her new passport. Link to comment
JoeF
She is currently overstaying, i.e., illegal. Just updating the I-94 won't work because she is illegal now. She needs to see an immigration lawyer. Link to comment

Her stay is illegal after her I94 expiry. Exit US immediately and enter with valid visa & a copy of your I797. Link to comment
paresh400
Please note that she is dependent to me (On L2 visa) and I have my I 94 valid until March 20, 2016. Do you still say she is illegal and cant do anything without leaving and come back to US? Link to comment
