EB2-NIW situation

Hi all,

 

I have 7 yeras of research experience in my field and would like to apply GC on my own. When I contacted attorneys, they suggested my profile may not fit strongly with EB-1, but definitely qualities for EB2-NIW. I am an Indian, so even if approved, it takes time before I get the actual GC.

My question is, if EB2-NIW is approved, can I resign my job and stay at home (due to personal reasons)? So when my dates become current, will I still be eligible to get GC? If I ever start working again, I will definitely work in my area of expertise. Never have any intention to change the field. But just wondering, if I can take a break from my work, but still be in queue for GC.

Yes, you can.

An I140, NIW or not, does NOT give you any immigration rights.

If you quit your job and stay at home, you would have to change to some other status, e.g., H4 if you are married and your spouse is on H1.

Thank you JoeF. Yes, I know that an I-140 does not give me any immigrant status. I am planning to change to a dependent visa if my NIW petition is approved.
