barat80 Posted October 8, 2015 Report Share Posted October 8, 2015 Hello All, I am currently on 6th year of my H1B visa and i got my EB3 - I-140 approved on May-2015 from company A. I am planning to shift to company B (Regular full time job) who is ready to file my H1B transfer and extension based on approved I-140 from company A . My questions are: 1. Will USCIS accept the application if company B file for my extension 11 months before my visa expiry (Oct-2016)? 2. Will I get my H1B transfer with 3 years extension or 1 yr extension if company B file with my approved I-140 from company A? 3. Company A cannot revoke approved I-140 after 6months from date of approval. Is this true statement or company A can revoke approved I-140 at any point of time? psraju Posted December 24, 2015 Report Share Posted December 24, 2015 I'm able to transfer my H1 and getting extension for my company b, c & d using my company A approved 140 from past 6 years. It will not be any issue until & unless company A didn't revoke your 140. Link to comment
