My employer filed COS to H1 this year but my name didnt picked up in lottery. What are the options left with me to continue work in US after my maxout date? 1. I am currently working as an executive and handling global teams, I am not sure if L1B to L1A COS would approve as I am on L1B(Specialized skill) for straight 4.5 years now. 2. Let say my employer file h1b in 2016 and it get pick in lottery, can I work continue from 1st june 1st after the maxout or do I need to leave the country and restart my work from 1st Oct? 3. Let say h1b didnt get picked in 2016 lottery and in may 2016 my organisation files L1B to L1A in regular processing. USCIS generally take 3-4 months to reply in regular processing, can i continue my work until the results come? Appreciate your response. Regards, Samith Link to comment
jairichi Posted October 8, 2015 Report Share Posted October 8, 2015 1. Not possible. Check with your attorney to confirm. 2. From 1st Oct and only for a year as the max allowed stay on H1B is 6 years and that includes your L1B stay. 3. No, you cannot. Link to comment
