Hi Guys,

I applied for H1 transfer and I got my approval notice yesterday and it was an i-797B with no i-94 attached. My i-94 from previous employer is valid till sep 2017. It says "I am not eligible for requesed extension of status" I dont understand what this means. Can i continue working in the US?

Any advice will be highly appreciated.

Thanks,

sanzig

Did you got notice saying why you are not eligible? if yes, what is reason?

Well I am in same situation. reason says that I am not physically present in US.

last came to US on L1B in 06/2014 with company A

COS from L1B to H1B in June 2015 (Did not go for stamping), joined company B. have pay stubs and bank statement along with other documents to prove I am in status.

Company A filed for H1B transfer and EOS. H1B transfer approved but EOS denied with reason saying I am not physically present during entire process, which is not true as I never left US since 06/2014.

Employer/attorney has to contact USCIS and get it corrected.
