Can my wife enter US on H4 while my H1B amendment is still being processed?

Hi All,

My wife has her H4 stamping till Dec 31st, 2015.

 

I recently got my H1B extension approved till Jul 2018 but soon after I had to change the project so now I have filed for an H1B amendment in regular processing.

 

My wife is planning to enter the U.S(this is her first time) on H4. I am not sure how does it work at the POE.

 

Is her H4 visa good enough or does she need to show a copy of current I797 which is valid till Jul 2018 so that she can get an I94 till Jul 2018. Will she have any issues at POE as my H1B amendment would still be in processing?

 

I am a bit confused here. Please let me know what would be the best and the safest option.

I have  a similar issue. My husband got a H1 stamped last year, but because of some circumstances, he did not travel.This year, he had to change employers, so they filed a cap exempt H1B and he is currently in the US. I and my child are planning to travel this year.My H4 was stamped when my husband was with the first employer.

Question is 

1) Can I travel with the same H4 ? Does it have to be stamped again ?

2) Does he have to file H1 amendment ?

Ideally she needs a copy of your amendment approval to enter US. Check with your attorney.
