H1 6 year Clock reset

Hi all,

 

I came to USA on Apr 2013 and stayed till Nov 2013. I was out of USA from Dec 2013 till Feb 2015. I came to USA again on Mar 2015. 

 

Will my H1B 6 years clock reset? Please let me know.

Your clock will reset only if a cap subject H1B petition was filed after you stayed outside US for a year.

It did not reset.

For the clock to reset, a person has to stay abroad for at least a year and then a new H1 under the quota has to be filed.

No. Your 6 year clock is not reset. You need to go through the lottery system again to get back the 6 years after staying out of US for more than 1 year. Looks like you came back on the original petition that was issued 2013.
