B - visa is Non-Immigrant Intent where are I-140 is immigrant intent. is it possible that the case might get rejected at visa interview?. is there any possible way to visit(a month) US after I-140. would appreciate your views. JoeF Posted September 4, 2015 Report Share Posted September 4, 2015 On the application, you have to answer yes to the question "Has an immigrant petition ever been filed for you?". The I-140 is an immigrant petition. It is very unlikely that a visitor visa application would be approved, since the I-140 shows that you have immigration intent. Link to comment
