B visa after I-140

Hi There,

 

What are the chances to visit US on B visa (B1-Business, B2- Visitor) after I-140 was filed/approved.  B - visa is Non-Immigrant Intent where are I-140 is immigrant intent. is it possible that the case might get rejected at visa interview?. is there any possible way to visit(a month) US after I-140. 

 

would appreciate your views.

On the application, you have to answer yes to the question "Has an immigrant petition ever been filed for you?". The I-140 is an immigrant petition.

It is very unlikely that a visitor visa application would be approved, since the I-140 shows that you have immigration intent.

If the I-140 benefiter already possess B-visa before filing I-140, can he/she use it for short term visit to US when I-140 being processed.

Using an old B visa when an I-140 is filed can easily result in a denial of entry at the POE.

They have all the information in their database.

It might possibly lead to denial of entry to US at POE.
