I quit employer A and joined employer B and they have filed my H1 transfer on Aug 21st in normal processing only. My question here is : My visa is going to expire on Sep 30 2015, since i heard USCIS used to take 3-4 months to come up with the decision for normal mode and i would like to know that "Will USCIS extend my petition dates along with the transfer"? Please do note that i have used only 3 years of my stay in H1B and also my previous employer H1 petition was valid till 10/2016 but i hope sooner they will revoke my petition. -Surya Link to comment
jairichi Posted August 28, 2015 Report Share Posted August 28, 2015 Based on a timely filed H1B petition you are in status in US till a decision is taken on that petition. You will get a H1B validity based on duration requested by employer and USCIS discretion. Link to comment
