Scenario: Both EB2 and EB3 Current

Hi,

 

Need some expert advise.

 

Details:

 

EB3 Priority Date - Oct 2004

Applied for 485, I-140 in 2007

 

Porting to EB2 process started last year with the same employer and for a different position.

 

I-140 approved last week.

 

Coming September 1st both my EB3 and EB2 dates will be current.

Which one would USCIS consider?

and also if there are no EB2 visa numbers can I request it to be processed under EB3?
