H12015aspire Posted August 22, 2015 Report Share Posted August 22, 2015 Hi Experts, My Employer informed that my H1(New H1-2015 April Quota) got RFE from USCIS. Here is my case. Pl advice me on this. I Have B.Tech Mechanical Engineering Degree( 4 Years). I have IT work experience about 7+ Years in India. How to justify in this case? Pl advice me in this case. Link to comment
JoeF Posted August 23, 2015 Report Share Posted August 23, 2015 For an H1, the beneficiary has to have the equivalent of a 4-year bachelor degree in the field of work. 3 years of experience in the field of work can be used for each year missing towards the required degree. Since you have neither a degree in the field nor the 12 years experience required without having the degree, this H1 is likely to get denied. Link to comment

My attorney asked to submit experience letters, technical certifications and pay stubs as supporting documents. Any advice will be helpful. Link to comment
JoeF Posted August 25, 2015 Report Share Posted August 25, 2015 That has nothing to do with STEM or not. For an H1, you have to have a degree in the field of work. That means, for a job in IT, you have to have a degree related to IT. Your degree is in ME, not in CS. That means you could get an H1 for an ME-related job, you can't et an H1 for an IT-related job. All I want to say is don't loose hope if you have RFE on experience related to field of work. With your experience you have chances to get it approved. Stay positive and thanks for your support.
