My PERM is approved and I have applied for my I-140 (premium). There is an RFE on my I-140 and my attorney has responded to it today. Just in case my I-140 gets rejected, can I still go ahead and apply for my H1-B extension? Can I re-apply for my I-140? Please advise. Link to comment
jairichi Posted August 3, 2015 Report Share Posted August 3, 2015 An approved PERM does not get you an extension. Only an approved I-140 or PERM or I-140 pending for a decision for more than a year will get you an extension. Link to comment

If employer wishes an I-140 can be filed again. Once approved you can enter US with a cap exempt H1B petition approval. Link to comment
