PERM revoked | 7th year extension expired | I-140 not applied | Can it be renewed?

Hi Folks,

Last year my then employer who had filed a PERM for me (which was approved) was revoked, when I decided to resign. I had a 7th year approved extension too which expired a few months back. I had moved on to a canadian employer.

Now, I am contemplating of joining back my former employer in the US. Is there any action I can take on a revoked PERM and and expired extension, to "revive" my status in some way? Or do I have no other option but to file a fresh H1b visa?

Any expert opinion on this matter will be greatly helpful.

Regards,

That PERM is gone.

The employer would have to file a new H1 in the quota after you have been abroad for a year.

You don't say when you left, but a new H1 can only be FILED after you've been abroad for at least a year. For example, if you left in May, a new H1 could only be filed in May 2016. If the quota is full by then, it could only be filed in April 2017.
