ctmask111 Posted July 30, 2015 Report Share Posted July 30, 2015 Hi All My 6 year H-1B term is expiring on Sept 25, 2015 (according to the visa stamp). But my I-94 date says Oct 2, 2015. I am planning to leave to my home country on September 27, 2015. My question is "Will I be considered OUT OF STATUS" if I leave on Sept 27, 2015 when my company files a new H-1 visa for the next fiscal year beginning on Oct 1, 2016. jairichi Posted July 30, 2015 Report Share Posted July 30, 2015 No, issue. And, your employer can file a cap subject H1B petition only after a year you stayed outside US. That means it can be filed on Sept 2016 which actually means April 2017. Link to comment
