Last time I was in USA on h1b , I was looking for a job although I was not receiving any salary. I came back after 6 months due to bad economic conditions and unavailability of jobs. Can they ask any question regarding this in the interview after checking my last employment details through my SSN number? I was not doing anything illegal, only not receiving any salary. JoeF Posted July 2, 2015 Report Share Posted July 2, 2015 Well, not receiving a salary on H1 *is* illegal. You *had* a job, with your employer. It is the employer's task to find you a project. He has to pay you, even on bench. Why didn't you file a complaint with DOL at that time? You need to provide your SSN. And they know about your previous H1 anyway. It is all in their files. I am getting this visa (cap exempt) only because I was not able to utilize my earlier visa due to general recession in US. Can I just say I dont remember my SSN no and check dont apply under SSN? Will there be a chance that my visa may get rejected just because my earlier employer didn't provide pay due to lack to project. Link to comment

A lie would result in you never getting an H1 again. Rule #1: NEVER lie to an immigration official! They have all the information in their file about you, from your first entry to the US to now. Ever heard of databases??? This is not the 18th Century, this is the 21st Century. A lie would kill your future in the US. NEVER NEVER lie to them. It is THAT simple! Link to comment

I have all the other documents in place and also got client letter head from apple which is my employer. I will truthfully tell them the full story, if probed , that I didn't receive any salary as I was on bench back then. Also, should I check that I have overstayed in US for some time in DS-160 as I was in US on H1b but was not receiving any salary. Link to comment
JoeF Posted July 6, 2015 Report Share Posted July 6, 2015 It probably depends on how long ago this was. If it was recently, I can see problems, if it was 5-6 years back, probably not. In any case, no matter how long ago, a lie would make things really bad. Being truthful is the best, the only option you have, And if the I-94 was valid, you were out of status, but didn't overstay.
