H1B Transfer

Hi,

I am currently on Bench from past 2 months for Company A and recently got a job from Company B so I am planning to transfer my H1B.

In my current company they have run the paystub for last month but on the paystub it shows as Zero dollars, I want to know if this will create any issues in my H1B transfer. Is the paystub which was run for Zero dollar amount valid or not?

The employer needs to pay you at least the salary listed on the LCA.

They need to pay that ALL THE TIME, even if you are on bench. That's the law, and the employer knows it.

If they don't want to pay you, file a complaint with DOL on form WH4. The DOL will make the employer pay you.

And find another employer, one who follows the law.

You need to get paid even when you are on bench. File a complaint against that employer, your H1 transfer will be rejected for being out of status. Only a complaint can help you out.
