yugenhelp
i am due for my H1 extension (7th year) based up on my PERM FILING with company A. My H1 is expiring Sep 2015. However, company A merged / got acquired with company B. Now my employer wants to transfer my H1 to company B and at the same time extend it as well.My employers are consulting with lawyers regarding this situation. Nevertheless, I thought to check here and see if anyone has any experience regarding this. I am of the view that employer should be filing H1 extension under company A, because PERM was filed under company A. Can anyone please let me know if you have experienced this sort of situation? I am worried that my H1B extension might get denied if they file for an H1 transfer plus extension under company B.Any points regarding this is greatly appreciated. Thank you! Link to comment
Jyothis
If the company changes, as far as I know the process has to be re-started with the new employer. It will also depend on if Company A will cease to exist after the M&A Link to comment
