To copy my answer from another forum:

Only universities, non-profit research organizations affiliated with universities, and government research organizations are cap-exempt.
The organization you mention does not seem to be any of these. It is a state government organization, but not doing research. Therefore, an H1 from them would not be cap-exempt.

This question should go to your company's HR or the attorney. A few hospitals are also non profit. 

 

Hospitals that are affiliated with universities are cap-exempt, like university medical centers. That's covered by the rules I mentioned above. Not all non-profit hospitals are cap-exempt.
