Aditi Malhotra
Hello, I am currently located in India working with company A and I have applied for my with a consultant B. If my visa is approved, then I will be going for stamping in September. I want to understand that, if my stamping is completed in september, Can i get my H1 transferred to the company A and then travel to US with company A (rather than going with the consultant). Request you to please help me with this, so I can plan accordingly. Regards, Aditi Link to comment
jairichi
Yes, employer A can file a cap exempt H1B petition after October 1st. Care must be taken that consultant B does not revoke your H1B petition before Oct 1st. Link to comment

jairichi
Thank you Jairichi. Will I need to go for stamping again once my H1 is transferred to my new employer. Not required. You can travel with the valid H1B visa (from old employer) and new employer's I797. Link to comment
