Visitor visa extension, leaving the country while its pending

Hi,

 

I applied for Visitor Visa extension for my mom couple months ago. The application is still pending. She will be leaving to India next week as she is not doing good health wise.

 

1) Is it ok to leave the country while the extension is pending? (However she overstayed her I-94).

2) Will there be any problems at port of entry, next time when she visits?

1. Yes, fine.

2. Yes, she will be scrtuinized a bit more because her EOS application will be in her record.

It is OK to leave. The EOS petition will be considered abandoned when she leaves.

Not sure if she may face problems next time. Technically she has overstayed the visa.

No problem, she can leave US at any time.

Thanks all for your inputs. I guess, we have no choice but go to India next week. Lets see what happens when she comes back again next time, may be i should accompany her during her next visit so i can answer POE officer's questions.

Sometimes, the online case status will not be updated properly. Call USCIS to check the current status. If the status is approved then she is good. But make sure to follow up till you receive the approval copy and send to her, so she can carry next time.
