EB2 - Masters (from pre-accredidated university)

Before asking question. Here is background.

 

I Joined international technological university on May 18 2011 for graduation and received my Masters in Software Engineering on May 18 2012. (International Technological University (***) is a non-profit, private universityin San Jose, California)

 

·         On June 24, 2011, *** has been recognized as a Candidate for Accreditation by the Accrediting Commission for Senior Colleges and Universities of the Western Association of Schools.Soon after, the U.S. Department of Education added *** to the list of nationally recognized higher education programs.  (I am Assuming  pre-accreditation Is nothing but Candidate status)

·         On February 22, 2012, The Council for Higher Education Accreditation (CHEA) placed *** on the list of recognized accredited and candidate universities.

·         In Dec 2012, *** got official accreditation and given WASC-accredited degree for graduates from December 2012.

·         *** is also recognized as an approved institution by California’s Bureau of Private Postsecondary Education (BPPE).

 

So, during my study (May 18 2011 - May 18 2012) *** had candidacy status (which means pre-accrediation i guess)

Do i qualifying for the below criteria for H1B under masters quota?

 

In addition to meeting the above standard, the claimed masters degree must be issued

from a U.S. institution of higher education as defined in section 101(a) of the Higher Education Act of 1965. That section provides as follows:
For purposes of this chapter, other than subchapter IV and part C of subchapter I of chapter 34 of Title 42, the term "institution of higher education" means an educational institution in any State that--
(1) admits as regular students only persons having a certificate of graduation from a school providing secondary education, or the recognized equivalent of such a certificate;
(2) is legally authorized within such State to provide a program of education beyond secondary education;
(3) provides an educational program for which the institution awards a bachelor's degree or provides not less than a 2-year program that is acceptable for full credit toward such a degree;
(4) is a public or other nonprofit institution; and
(5) is accredited by a nationally recognized accrediting agency or association, or if not so accredited, is an institution that has been granted pre-accreditation status by such an agency or association that has been recognized by the Secretary for the granting of pre-accreditation status, and the Secretary has determined that there is satisfactory assurance that the institution will meet the accreditation standards of such an agency or association within a reasonable time.

Can I use master degree for green card filing under EB2?

i have all my attendence, project and home works with me and FYI i didn't take any CPT. But thing is you dint answer from question.

 

Do i qualifying for the below criteria for H1B under masters quota?

Can I use master degree for green card filing under EB2?

Please talk to the attorney who is filing your GC application. Since your univ has abused CPT, you can expect an RFE.

FYI, if it is fraud, WASC won't give accredidation. i want other senior members to help me with my question. Anyways thanks for replying.

 

That insitution is abusing the CPT rules.

That has nothing to do with accreditation. WASC doesn't check that.

They are still a fraud, even if they managed to get accreditation.

DO not use a degree from that fraud. It is THAT simple.
