Travelling with AP being on H1B

Hi,

 

I have applied for change of status (I-485) on December 9, 2014 after I-140 (EB1a) approval. I have received EAD and AP on March 9, 2015. Currently I hold H1B (academic) status however, I do not have H1B stamp. I am planning to visit my family in India in the month of June 2015 although I am not sure whether I will have my GC by then. According to current processing timeline it will take 6-8 months to get I-485 approval from TSC. My question is -

 

1. can I use AP to return to US without having H1B stamping ?

2. If I return US using AP, will my H1B status be invalid ?  

 

What would be the best option to travel in this situation. Any suggestion is highly appreciated. Thank you

2. Yes. Why would it make a difference to you? Having EB1a approved suggests the H1 status is redundant and unnecessary.

How was your recent experience travelling with AP to India. I am very much in your situation; got my eb1a I-140 approved in Febuary 2015, applied I485 in april, 2015, already received EAD and AP in May. I am planing to visit india in September 2015. I am in h1b visa at the moment (academic), but its not been stamped in to my passport. I have no plan to visit consulate office, and instead want to use AP for my travel. please let me know how was your recent experience in using AP for India travel. Also, did you get your 485 approved? Mine also pending in TSC, and its already 3.5 months after 485 submission.
