Green card when sponsor and family outside the U.S

Recommended Posts

Hello,

I have a 5 year old daughter who is a U.S citizen. We are looking to relocate to India as a family (Myself, My wife and daughter) and do expect to be back after 10 years for their higher education. We are expecting a new baby. My wife and I are green card holders.

Here are my questions. USCIS website doesn't suggest on age limit and employment status. I kindly request some guidance on these questions. I also tried looking up details in prior forum discussions.

1.       As soon as we go to India can my daughter sponsor green card for her sibling? Otherwise what is the requirement? Should she be employed in the U.S or in India?

2.       After a few years what is required of my daughter sponsoring green cards for my wife and I while we all are in India?

3.       After a few years, if my wife and I are green card holders through our daughter can I quickly get green card for my new born baby?

4.       If I140 gets approved sooner than required (I hear it take 12+ years) can I postpone filing I485 by years?

5.       I am hoping there is some kind of visa using which the new born can get inside the U.S while green card is getting processed?

Thanks,

Shankar.

When you move out of the US, you automatically lose your GC.

A US citizen child has to be 21 before the child can sponsor the parents for a Greencard.

And to sponsor a sibling, the US citizen obviously has to be able to sign the paperwork, which means the US citizen would have to be an adult.
