satya.svits29 Posted March 26, 2015 Report Share Posted March 26, 2015 Hello All, I came to the USA in 2013 April on H1B through company A. The I797 and Visa are valid till Oct 1st 2015. My Wife and Kid also have Oct 1st 2015 on their visas. I joined company B in 2014 and got the new I797 till 2017 August. My wife and kid are travelling to India in June 2015 and will return in August 2015.(2 months before the visa expiry date). Now do i need to file an i-539 for their extension or can they use my new petition at the port of entry and get a new date on the I94. Please clarify. Thanks a lot in advance. Satya Link to comment
