In Dec2014, I have applied for extension through another US employer (not the same one as initial H1b) for the entire unused period. On 16th March'15 H1b petition got approved as per USIS website. On the same date (16th March'15), I got an offer from another Indian Company. I decided to change & work in India till the H1b is stamped. Now this new Indian employer is asking me to take a B1 visa to handle some business discussions lasting for 3.5 wks which would start around 20th Apr'15. I am worried if this parallel process will harm/conflict with H1b process. If I can go ahead with B1 process, should I postpone the H1b visa appointment and do it only after I return back ? ashuneel Posted March 27, 2015 Report Share Posted March 27, 2015 The Dec2014 petition through another US employer is not an extension but a new cap exempt H1B. Since you got an offer from another Indian Company and decided to change & work in that company the earlier H1B should be revoked by US company. You can go ahead with B1 process. Link to comment
