140 Approved in May 2008 and currently out of USA

Need urgent help as H1 dates are closing.

H1B

on H1B from 2000 till Nov 2011; currently have B1 multiple entry visa.

 

out of US since 2011. Based on this GC status , Am I eligible for H1B Exempt Quota?

 

then should I apply for new H1B to enter US?

You are eligible for cap exempt H1B petition only if your I-140 is not revoked by employer. Talk to an attorney from Murthy law firm immediately with all documents.

Also u cannot but ur employer needs to apply for your h1

Thanks. Yes I am on EB3. I checked online and I140 is still active so I should be Exempt.

 

How to find out if my PD is current or not? sometimes the visa bulletin info is not same as what PD is currently getting processed. What I should do regarding GC as I need to enter US with different employer.

The Visa Bulletin and only the Visa Bulletin lists the current PD.

Can you brief us on how to check if the I-140 is still active? Are you referring to the USCIS case#?

 

Btw, do you have the copy of the I-140 approval notice with you? I was told we need the copy of the approval for a company to apply for a H1B non exempt.
