Changing job on EAD - 485 pending & current in Apr-2015

Hi,

 

My priority date is 21-Jun-2007 and filed I-485 in July-2014. I got my EAD in Aug-2014. My PD is current in Apr-2015 & I-485 is in pre-adjudicated status. My H1B is valid till Oct-2016.

 

I have got an FTE offer and employer is asking me to join in 4 weeks. I'm not sure if I'll get GC before I join the new employer. I need some advise on following:

 

• Would changing employer affect by I-485 processing if it is not approved before I join the new employer?
• Would there be any implications if I receive approval prior to joining new employer?
• Would this impact processing for dependents in any way?
• Is it better to wait for I-485 approval or invoke AC21?
• Does address change on I-485 impact processing or card delivery?

1. If there is RFE on I-485 your current employer may not respond and jeopardize GC process.

2. Generally it is not advised to do so...for fear of intention of fraud.. changing employer as soon as you get GC may be red flag. There is no data for this but mentioned on the forum multiple times.

3. If your GC is not approved dependants will also face trouble.

4. You can use AC21 but consider all implications.

5. address change does not impact processing outcome.
