Ganesh1983 Posted March 3, 2015 Report Share Posted March 3, 2015 Hi, I got I 94 till Dec 2014 because of my passport expired on Dec 2014. It almost 75 days overstayed. What should i do now? I noticed this very late. I am plainning to travel to india in march 28. If i go to visa interview, will it be solved? PLEASE HELP. Thanks in advance, Ganesh.R Link to comment
jairichi Posted March 3, 2015 Report Share Posted March 3, 2015 You are accruing illegal stay in US and if you are working that is unauthorized employment. Exit US immediately and enter with a valid visa and I797. Link to comment

pontevecchio Posted March 3, 2015 Report Share Posted March 3, 2015 Talk to your employer and leave and return with the visa. If you overstay 6 months, you have a 3 year ban and 10 years if you overstay one year. Link to comment

The previous visa is stamped and valid until 2017 . I am planning for crossing Tijuana Border and get his I94 renewed what are your thoughts- 1. IS there any risk involved that they might deny at the border to enter back into US? 2.What documents do we need to carry for for son apart from his Passport and and approval notices? 3.Do we need to tell the Officer that my son's I 94 has expired and this is the reason we are coming here ? 4. is there as seperate line for I94 issues? I don't think they is any risk involved. Because I checked with some Officers in LAX office, they suggested to go Maxico. 2.What documents do we need to carry for for son apart from his Passport and and approval notices? Company Letter. They asked me to show company Letter that what i do. 3.Do we need to tell the Officer that my son's I 94 has expired and this is the reason we are coming here ? After Officer seeing my I 797 and Visa, He said that I dont have any issue, I am good to go. I requested them to update new online I94, So that I can a printout. LittleMaster Posted May 9, 2015 Report Share Posted May 9, 2015 Just want to share my experience here : There are 2 PoE ( Port of Entries) for San Diego/Tijuana border. Tijuana PoE is most busiest border on foot. It might take 3 – 6 hours on a weekday depending on the people Otay Mesa : This border crossing is not crowed and I-94 will be issue within a hour. Address : 9777 Via De La Amistad San Diego CA 92154 Initially Officer mentioned , I dont have to change anything in my I94 and looks good and let me enter US witout time entry stamp or any form filling. I had to return inside which was next to impossible after you cross the Immigration guys , When I checked online on my phone that my I-94 did not get updated . I had to explain and after lot of pleading and requests , it was kind of funny they passed on the I94 forms and told me to fillup and immidiately got updated online .
