File new PERM and I-140 after changing jobs on H1B

Hello,

 

I am told that if you change job from Employer A with whom you have approved PERM and I-140 to Employer B then Employer B will have to file the PERM and I-140 again. Is that correct.

 

I am also told by some that according to new Obama Executive order if you change your job to employer B then Employer B does not have to file for new PERM and I-140 , you can retain your old approved PERM and I-140. Is that correct.

 

Please help me to understand which one is correct.

Seniors,

 

I am working on my employer payroll from past 4 1/2 yrs. Labor approved, waiting for I140 approval. Priority Date (PD) is Jan 2014.

 

I 140 submitted in Sept. 2014 and expecting it to get approved by end of 2015. My concerns are below:

 

1) Can I join a new employer who is a prime vendor for a big end client.

2) Be with the current employer, wait until I140 getting approved

3) When is the good time for me to move to different employer without missing my above PD.

Can you please tell me in more detail...1.5yrs approval means is it my next H1B time frame...instead of 3 yrs will it be for 1.5yrs....

 

        1.you can join new employer but you will get 1.5 yrs approval  ---- ??

yes. It will be 1.5 yrs for new employer  as you do not have approved I-140. You can only go past the 6 yrs if you have approved I-140 or  PERM/ I1-40 pending for more than 365 days. In the situtation you have pending I-140 you will get 1 yr extension after the first 6 yrs.
