Hello,

I am writing to inquire if my wife would be considered as 'violated immigration laws' and need your help in understanding the same

My wife was on H4 visa, enrolled as a full time Graduate student last semester and we have applied for COS to F1. We checked our application status online, which said our application was approved but we had not received the approval notice.

She went ahead and started applying for jobs on campus the very same day but did not work or accept employment. We did not receive her approval notice until 3 weeks later after that day.

Please advise if she has violated any immigration laws (for H4)

Thank you

Hello

Need advice.

My wife is on H4 Visa and currently studying  for a Masters program in engineering with a University in California.

Considering her  as a California resident they offered her with a Graduate Student Researcher role. This offer includes covering her California resident Tuition fee and a monthly payment.  She notified the University saying, H4 visa status does not allow her to be employed or receiving any payments and she had to decline the offer.

University withdraw the offer for GSR.  Considering her as California resident and her outstanding GRE scores University selected her to receive a fee waiver of her resident tuition fee. The fee was internally covered by university. She accepted that offer and started her studies. Since we are not receiving  any money in hand or back account we assumed receiving tuition waiver is Ok.

My concern is, are there  any issues going forward with H1 / H4  status or green card processing by accepting this tuition wavier. Any Tax issues ? recently received Form 1098-T from the university showing her tuition fees paid by university

Please advise.
