Answering Visa officer

Hi,

 

With my approved I-140 and petition, if the visa officer asks on how long would i stay in US? What should be my answer? Since for one, they want H-1 holders not to stay long in US, but I-140 as part of GC is an intention towards where the individual opts to stay longer.

 

 

One more question:

My spouse is currently on H4. Also, I am planning to apply a new H1 for my spouse on April. Now with the new bill that H4 EADs are permitted for dependants of I140 approved members. Can i still try out the lottery luck for H-1 for my spouse, so as then i will doing a COS(Change of Status) for my spouse's H4 to H1.
