EB 2 Qualified?

Hi,

 

I need to validate if the below position requirement qualifies for EB 2 category?

 

Any suitable combination of education, training or experience is acceptable, consistent with H-4 through H-14 of this ETA Form 9089.  Job requirements include a Bachelor’s Degree in Computer Science, Engineering, or Mathematics and 4 or more years of work experience or a Master’s Degree in Computer Science, Engineering, or Mathematics and 2 or more years of work experience in a programming or application development role; experience with SDLC, product development methodologies, database methodologies and integration; experience with coding and documentation protocol as well as unit testing, change management and release procedures; 2 years of .Net development experience; 2 years of C# experience; 2 years experience with ad-hoc SQL scripting; experience writing SQL queries; experience with Unix, NT, XP or Windows 7 OS; experience with SQL Server and Web services; experience with Versioning tools (Rational Clear case or TFS); experience with Debugging tools (logtrace or log4j); experience with MS Office Suite and Visio; experience with Claims processing.

Here minimum requirements are- Bachelor’s Degree in Computer Science, Engineering, or Mathematics and 4 or more years of work experience

USCIS requires Bachelor degree + 5 yrs experience for EB-2 so this will not qualify.  Although masters + 2 years is also acceptable they will consider minimum qualifications first  and that falls under EB-3.

Hi i have couple of questions please help me. My employer wants to file my green card under EB3 but i have 4 years Bachelors 2002-2006 & 2 years masters 2006-2008(4+2) from India and 4 years experience prior to my current employer 2008-2012 worked in India and joined USA Company in 2012 till date.


My employer said at beginning he will file my GC under Eb2 but now says i don’t qualify for EB2 he wants to file under Eb3 what should i do now please help me.

If your job requires only a 4 yr bachelor and less than 5 yrs experience it will be EB3. Job requirements are more important than your qualifications.

your quals definitely pass the EB2 criteria...but it is the job criteria that should require an EB2..

 

if ur employer says you don't have necessary quals then he's wrong...it doesn't cost him extra to do an EB2..so whatz his problem?

 

speaking of job being qualified as EB2, it is a known secret that, employer's attorneys take ur quals and then weave the job description around it, as long as it is an engineering position or similar..
