medfreak Posted February 11, 2015 Report Share Posted February 11, 2015 I am on a J1 visa as an alien physician enrolled in graduate medical education. I got married to a U.S. citizen for almost two years now. I am in the process of applying for a hardship waiver via an experienced attorney. I have received my last DS-2019 which will last till 6/30/2016. My question is, if the hardship waiver gets approved, do I need to go back to home country to get an adjustment of status (similar to what an H1B would require) or would I be able to adjust my status to a green card while I am in the united states? Bernard Posted February 11, 2015 Report Share Posted February 11, 2015 No need to go home before adjusting your status if you get the waiver. You can do any adjustment within the US. Link to comment
