E2B Filing and Final Settlement

Hi,

 

I work for a employer X and PERM(EB2) was filled couple of months ago. Now that I have resigned, there are two issues that I would need clarification/help:

 

1. X says, USD  7K would be deducted  from my pay as I moved out of X as X spent for filing PERM.  

  I am aware that GC for EB2 occurs in 3 phases:

  a. File PERM

  b. File I140

  c. File I 485

USICS do not charge for PERM filing. It is illegal for employer to charge employee to pay for GC. Now, how do I handle employer now ? 

 

2. X says.. they would not pay me till they get paid by client. X doesn't even respond with clear clarifications. I think, this is another way of saying You will not be paid from now on.

This is illegal and I have all the proofs of timesheets approval from client, start date and last  

   date, etc. How do I handle this smoothly to ensure X pays till the date I have worked.

Either follow the law or leave US. Without latest paystubs you cannot file for H1 transfer, then leads to rejection and then finally you have to leave Us.

 

Now that you are not ready to file a complaint, that makes me suspecious that something is wrong from your end.

 

Thanks for the incredible advise !!. I have all the latest payslips and my H1 is already transferred. Who would resign like you think without having their h1 transfer approved ?

I think u r best in jumping into conclusions rather than providing a better suggestion !

Either you file a complaint or forget about that money. That's the only option you, go ask any immigration attorney.

Like I said before if you won't file a complaint, it makes suspecious to anyone that something is wrong on your end. But you made it clear that you did no mistake, so what's wrong in filing a complaint?
