jvivekan
Hi – I am on L1-A in USA right now work for Employer A. I got my L1-A in 2014 and have visa stamped till 2017. If I apply H1-B through Employer B on 2015 CAP (filing in April 2014) and get approved, will that impact my L1-A status? After getting H1-B approved effective Oct 1st, if I want to continue with Employer A on L1-A, can I do that? Link to comment
jairichi
Let employer B file H1B petition as consular petition and not change of status (COS). In this way you can continue working for L1A employer beyond Oct 1st. Link to comment
jvivekan
Than you. There was typo in my message, it should be April 2015 not 2014. I have two more questions, 1. If I get my H1-B through consular processing say in August 2015 with a effective date of Oct 1 2015, in that case can employer B file H1-B transfer with COS? 2. Do I need to travel outside USA for stamping if I decided to use my H1-B that I got through counselor processing? Link to comment
jairichi
1. Yes. But, will they be interested to pay H1B fee again? 2. Yes. Link to comment
jvivekan
Appreciate your response. Employer C is a big MNC who will not file new H1-B where as they will file transfer of H1-B. The H1-B amount doesn’t matter to them. Can Employer C file H1-B transfer as H1-B COS on the consular H1-B approved for Employer B? Link to comment
