Due to unavoidable situations I have to travel India first week of Feb and return by 2nd week of April. Is it going to create any kind of problem to H1B processing? Please suggest how can I proceed. If your H1B petition is filed as change of status (COS) during your stay in US and if you travel before a decision is taken then your COS part of H1B petition is considered abandoned due to your travel. To start working from 1st Oct you will need to enter with a valid H1B visa and I797. Link to comment

Alternatively, your H1B can be filed in premium processing (15 days to get decision) and you might get a decision before your travel. Link to comment
