hou2hou Posted January 21, 2015 Report Share Posted January 21, 2015 Hi, Got couple of clarifications on GC process: 1) If PERM/Labor is pending or on hold - Can we extend H1b (if I complete 6 yrs by then) only on basis of "pending/on-hold" status? 2) If I-140 is pending or on In-Progress - Can we extend H1b (if I complete 6 yrs by then) only on basis of "pending/In Progress" status? 3) In general - What is the rule- how many months in advance one should file PERM and I-140 so that H1B can be extended incrementally? shandan Posted January 21, 2015 Report Share Posted January 21, 2015 for extention of H1b beyond inital 6 yrs, with an approved: PERM: 1 yr incremental extensions I-140: 3 yr incremental extensions with Pending: PERM: only if the application has been pending for over 365 days from the date of filing, then 1 yr incremental extension. I-140: not a criteria for extension. Link to comment
