panthar
I have H1B approved from a employer ABC. I did not go for stamping yet. My current employer (NOT ABC) is ready to relocate me to USA under L1A. I want to seriously take L1A and forget about H1B visa. Question: 1.) When I go for L1A stamping will my H1B approval create any problem ? 2.) Do I need to mentioned anyone that I also have H1B approval in hand ? Link to comment

panthar
I have H1b approved (ABC company) Spouse has H1b approved & stamped from same ABC company. I have go for L1A from my current employer DEF. Thanks a lot for reply. My current company is going for L1A now, just waiting for the papers in Feb 2015. Stamping in Mar 2015 probably. My spouse has H1B approved and stamped in her passport from same employer who has my H1B approved also (mine is not stamped), I was waiting for my current employer to see if they can send me on L1A (which they are now). question: 1.) My spouse has a valid H1B stamped on passport expiring in Oct 2015. shall she go for L2 ? or leave it as is and go on H1b and then do change of status ? 2.) Incase she goes for L2 (which we want) will there be a question why she did not go on H1B. 3.) Will they by default know that I (primary applicant for L1A) also have another H1b approved ? Any issues with that ? Link to comment
jairichi
1. She can enter on H1B only if she has a H1B job available through her employer ABC. Otherwise enter on L2. 2. No. 3. Yes, but will not be an issue. Link to comment
