Husband h4 rejected....overstay on previous visa....first time h1 stamping for me

Hi!

My husband and I came to USA on f1 visa 4 years back. I finished my masters and working on evc model from past 2 years. Got i797 till 2017. All supporting docs also available.I have applied for f4 for my husband 2 years back but got rejecTed as he over stayed in USA on his previous visa. Now I am planning to go to hyderabad for visa stamping.will his visa rejection be a problem for me?I am going now for the first time.what should I answer if they ask me where is my husband?

he overstayed for 6 months unknowingly. But this is back in 2011. I have got my H1 petition approval in 2013 and also got it renewed this year. It did not effect me in the petition. What about the stamping? will they be concerned on it?

You should be fine, for your husband's visa contact an immigration attorney.
