Travelling to India before first court date for Shoplifting

Hi All

 

I was arrested for shoplifting falsely. Its misunderstanding and I have all the valid receipts. But without checking the receipts, they handedover me to cops. Even they did not listen, they took me to police station, finger printed and given a court appearance ticket on 21 Jan 2015.

 

I was shocked with the things happened in the span of few minutes. I have hired laywer to find about this as innocent. I am on L1 visa currently valid till Dec 2015. I do not have any prior criminal records.

 

I have travel plans to go India for Christmas and come back by Jan 10 (before first court date). Anybody can suggest whether its safe to travel to India and come back in 2 weeks? Will there be any problem at JFK Port of Entry? I can travel with Court Date document and my Lawyer documents with me. I can say that I am coming back for work and attend this court date.  Still will there be any problem at the Port of Entry?

Thank you very much for your replies. I have verified with my Criminal Attorney, he said okey to travel and he said he will provide document saying that he is my attorney and he is dealing with this case. I will be carrying the first court date letter with me and I will show at the port of entry while coming. Unfortunately I do not have any Immigration lawyers hired, that is why asking the experts opnion/lawyers here.  Kindly help.

 

Do you think still, will there be any problem?

I am not sure a letter from your criminal attorney will be enough for you to travel outside US. I might be wrong by saying that a letter from court permitting your travel outside US might be required. Talk to an attorney from Murthy law firm with regard to immigration matters.
